    Question Need advice with my website (Legal Advice)

    Hey guys I had an idea to make a pokemon website, at the moment it is just for fun but if it did well maybe put some more time into it. Anyway the question I am asking and I apologise in advance if this is the wrong place to ask but I want to use images of pokemon and write reviews about them, maybe about their design and how well they do in the competitive scene.

    I was just wondering am I allowed to use an image of a pokemon? I see a lot of other sites that do but do they have permission? I am sorry if this doesn't make sense.

    TLDR: Can I use images of pokemon on my website?

    You must have permission to use any images you do not create yourself. This includes photography and or illustrations. You may see other sites using images but that does not mean it is legal.

    If there is no money involved, you won't get into trouble.

    That still doesn't make it legal, but keeps you off the radar.

    If you ask for any type of membership fees, or even ad clicks, you've crossed the line into trouble.

    Your site would sort of be like a "fan site" I guess.

    .... and maybe you can ask for permission. Asking won't cost you anything.

    The short answer: "it depends, but probably not".

    Images have different sharing and licensing requirements, and usually the ones that can be shared are on sites such as sxc.hu with clear license requirements provided. If they're not provided, the safe bet is to assume you can't.

    With something such as Pokemon, Nintendo owns the trademark.

    So...it's a safe bet that they own the copyright to the images. Now if you're screwing around on your own time for free, they generally don't mind...fans build sites all the time and Nintendo has been losing market share recently, so it's to their indirect benefit right now to have fans do as they wish as long as they don't take money out of Nintendo's pocket. Free fan sites generally don't do that. As Max said, that doesn't make it legal, but it gives you much more of an opportunity to beg forgiveness and get it should Nintendo see something that it doesn't like.
